On April 15th, 2020, the State of Wisconsin passed Act 185 into law. The Act is largely in response to the COVID-19 pandemic.  There are several provisions in the Act but this post is focused on the impact the Act has on worker’s compensation benefits for first responders.

Act 185 creates a rebuttable presumption that a COVID-19 injury to a first responder has been caused by that individual’s employment. The presumption requires a diagnosis or positive test for COVID-19 and the time period that the presumption will be in effect is between March 12, 2020 through 30 days following the termination of the Governor’s Executive Order 72.

While a good step for injured workers, Act 185 does not mean that injured first responders will have an “automatic” approval of their worker’s compensation claims.
