Jack worked as a law clerk for One Law Group last summer. Congratulations to Attorney Erik J. Pless

on his most recent trial victory!

Last week Erik tried his 83rd career jury trial as lead counsel and received a complete defense verdict.

This was a challenging slip and fall case where Erik’s client was alleged to be negligent for failing to salt a driveway in poor weather conditions. The case involved significant damages, including 3 past surgeries, significant disability, and the likelihood of at least one future surgery.

After a several day trial, a Price County jury found Erik’s client not negligent and assessed 100% negligence against the plaintiff.

Attorney Pless practice focus is insurance defense. He works with Insurance companies directly to protect insureds in significant bodily injury and legal malpractice cases. He also represents companies in bad faith and insurance coverage matters.

OSHA Announces Suspending Covid ETS

OSHA suspends the emergency temporary standard mandating covid-19 vaccines or testing for all private employers with more than 100 employees.

On November 3, 2021, President Biden and the Occupational Safety and Health Administration (OSHA) issued a sweeping nationwide emergency temporary standard (“ETS”) for the American workplace that would mandate hefty fines for private sector employers with more than 100 employees. The ETS forces all private employers to mandate employees be vaccinated for COVID-19 or tested weekly. The ETS would potentially impact approximately 180 million American workers—two-thirds of the national workforce. The ETS was set to be effective on January 4, 2022.

The ETS is the first time a federal administrative agency has mandated that a respiratory virus is an occupational hazard for private employers—essentially placing COVID in the same category as other workplace safety concerns such as asbestos and dangerous machinery.

Many states, large unions, and the Wisconsin Manufacturing Association have filed multiple lawsuits to challenge the constitutionality of the ETS. On November 18, 2021, OSHA announced it is suspending the ETS for private employers due to pending litigation. The USPTO has issued a Trademark Alert directed toward trademark owners and applicants, who are receiving fraudulent emails that appear to originate from the United States Patent and Trademark Office (USPTO), whose domain name is @uspto.gov.

Beware of the follow email messages:

1. Spoof of USPTO email address (e. g., n oreply@uspto.gov )

2. Falsely claim that the USPTO has a new policy requiring separate registration of “clients” and that there is a “penalty” for not complying.

3. Provide incorrect USPTO trademark filing information (e.g., incorrect fee information).

Worker's Compensation for First Responders

On April 15th, 2020, the State of Wisconsin passed Act 185 into law. The Act is largely in response to the COVID-19 pandemic. There are several provisions in the Act but this post is focused on the impact the Act has on worker’s compensation benefits for first responders.

Act 185 creates a rebuttable presumption that a COVID-19 injury to a first responder has been caused by that individual’s employment. The presumption requires a diagnosis or positive test for COVID-19 and the time period that the presumption will be in effect is between March 12, 2020 through 30 days following the termination of the Governor’s Executive Order 72.

While a good step for injured workers, Act 185 does not mean that injured first responders will have an “automatic” approval of their worker’s compensation claims. If this portion of Act 185 applies to you, or anybody you know, the attorneys at One Law Group are ready to help answer any questions and help fight for the rights injured workers are entitled to.

Evictions During COVID-19

Wisconsin has a temporary ban on evictions due to COVID-19.

Emergency Order #15 banned evictions and foreclosures between March 27th and May 26th, 2020. This Emergency Order may be extended or altered in the future, but here are some of the important takeaways:

Landlords CANNOT serve any notice terminating a tenancy for failure to pay rent;
Landlords MAY terminate a tenancy if the eviction is based on a reasonable belief that failure to proceed with the eviction will result in an imminent threat or serious physical harm to another person;
Mortgage note holders are PROHIBITED from starting a legal action for foreclosure on real estate;
Mortgage note holders are PROHIBITED from requesting or scheduling a sheriff’s sale of a mortgaged premises;

You may have heard of lenders and landlords working with people during these trying times, which is excellent to hear, but it is important to know that there is no obligation for them to do so.

Although temporary, these are significant changes to eviction and foreclosure law in Wisconsin. If you have any questions about your rights and responsibilities under Emergency Order #15, the attorneys at One Law Group are ready to help.

COVID-19 and Your Insurance Policy

Well, the easy answer is “it never hurts to ask.”

Here are some questions that you might think about before asking......

Do you have a loss of business income?

Is your business property uninhabitable or unfit for use?

Is the COVID-19 virus likely at your insured location?

Is your business closed because of a government mandate?

Does your policy specifically exclude losses caused by a virus?

Does your policy specifically exclude losses due to a government mandated closure?

Is your policy ambiguous?

If you believe you have a covered claim for property or business income loss due to the COVID-19 virus, ask your insurance agent to file a claim with your insurance company.

Essential Hearings During Safer at Home

In the current state of the COVID-19 outbreak there are a lot of questions as to what types of hearings the Courts will have during this time. Based upon the "Safer at Home" order of the Governor, the Wisconsin Supreme Court has provided some direction on what is considered an essential hearing. At this time the following are considered essential hearings:

In custody defendants, bond/bail hearings, preliminary hearings with time limits, review of sentencing after revocation hearings
Juvenile proceedings limited to JV/JC hearings
Termination of parental rights hearings
Mental commitments and guardianship cases
Family law cases - restraining order hearings, temporary order hearings if placement is at issue (Wis. Stat. §767.225(am)); enforcement of physical placement orders (Wis. Stat. §767.471(5)); relocation motions (Wis. Stat. §767.481(2))
Criminal jury trials with speedy trial demands will be reviewed on a case-by-case basis.
Individual judges retain their authority to make changes to these guidelines as the judge determines as necessary.

Please note that each county has some variation of what they consider an essential hearing. If you have a court hearing scheduled, your attorney will be kept informed on dates pertaining to your hearing. It should also be noted that even though your hearing might not be deemed essential it can still be scheduled for after the "Safer at Home" order is lifted.

Custody & Placement During COVID-19

We’ve been speaking with a number of clients over the last few weeks who are asking a similar question, “What am I supposed to do about physical placement exchanges under the “Safer at Home” order?”

Although the Court system has been mostly shuttered due to COVID-19, existing orders are still in full force and effect and should be followed. So does this mean that placement exchanges should continue unchanged? As with most legal issues, the answer unfortunately is “it depends on your situation”. Our family law attorneys have come to the consensus that absent some sort of emergency situation, medical order, or agreement between parents, physical placement orders should still be followed. There are a number of alternate arrangements and remedies that can be made during this time. While each situation is unique, the family law attorneys at One Law Group SC are in a position to provide tailored advice for your specific situation.

We at One Law Group hope that this letter finds you well. Much like everyone else, our firm is trying to figure out exactly what the coming weeks will look like with the impact of COVID-19 and precautionary measures that seem to change daily. As of the writing of this letter, your local courthouses are open with few restrictions. One Law Group is also open. Judging from how other county courts are reacting, we do expect there to be some action taken locally that would limit or suspend certain court proceedings. We will keep you informed of that information as soon as we are able.

Additionally, in an effort to comply with recommendations concerning the spread of the virus, we want you to know that there are several options available to you for communicating with our office that do not require you to meet with us in person. First, we can conduct meetings and conversations electronically through email or over the phone with ease. We also have the ability to conduct a video conference with you if that is your preference. In short, we want to do our part with respect to the virus while still providing you the best, most tailored representation possible.

With the Packers facing the Raiders in Winnipeg, Manitoba (not Alberta ), did you know that a drunk driving conviction (Operating While Intoxicated or OWI in Wisconsin) could prevent you from driving up for the game?

If you have an OWI conviction (even a non-criminal OWI 1st), there is a chance you might not be able to enter Canada. Canada treats OWI convictions seriously and may exclude you on the basis of this conviction. To overcome this exclusion one of two things needs to happen. Canada has the discretion to issue you a temporary resident permit, or you may be eligible to enter through a process called criminal rehabilitation. Commonly, criminal rehabilitation is only available after five years have elapsed since the completion of your OWI sentence. For these purposes, your OWI sentence includes the time period that your license was revoked. Finally, make sure that you plan ahead as it can take 12 months to process a criminal rehabilitation application.
